Release, Waiver and Indemnification

I recognize that participating in recreational activities, including tennis present some inherent risks to my health and safety. In consideration Tennis For Life, Let’s Play! and The Tennis Centre - Coquitlam (together as the "Centre") accepting my application for access to the Centre, I agree to accept these risks and understand that I am personally responsible for managing the health and safety of myself and any minors, dependent adults or guests in my care. I, for my heirs, executors, administrators and assigns, release and forever discharge the Centre, its agents and directors, employees, volunteers, and contractors or successors, from any claims, demands, damages, actions or causes of action arising out of or in consequence of any loss, injury or damage to my person or property incurred while attending or using the facilities of the Centre for any reason. I agree to indemnify the Centre, its directors, successors, agents or employees from any claims or demands which might be made against the Centre, its directors, agents or employees by others arising out of or in consequence of my actions while attending or using the facilities of the Centre. At their sole discretion, the Centre’s management and Board of Directors reserve the right to deny access to the Centre to those individuals whose behavior they deem unsafe or unacceptable.

Indemnification by Parent/Guardian (if applicant is under 18 years):

In consideration of the Centre accepting the attached application, I agree to indemnify the Centre, its directors, successors, agents or employees from any claims or demands which might be made for any reason against the Centre, its directors, successors, agents or employees arising out of or in consequence of the attendance at or use of the facilities of the Centre by the minors under my care who applied for either Centre access or participation in activities offered by the Centre.

Cancellations, Refunds, Attendance, and Program Placement

Refund Policy for Program Cancellations

Due to high demand for our programs, we kindly request that should you need to cancel your or your child’s registration in our program(s), please do so no later than 7 (seven) days prior to the start of the term in order to receive 100% refund. This gives us the opportunity to accommodate other players who are on the waitlist.

Cancellation requests made within 1-6 days before the first day of the term will incur a 10% fee or we’d be happy to offer you club credit instead.

Cancellation requests made 24 hours or less before the first day of the term are not eligible for refunds.

Refund Method

We only offer refunds onto the original payment method used.

For payments made by part-card, part-club credit, we will process the club credit refund first, then the card payment.

Processing Times

Refunds are applied within 5-7 business days from the moment we process the refunds.

Attendance

There are no make-up classes offered for classes missed;
No player substitution is allowed in any programs;
The coach reserves the right to move you into the appropriate class for your level.

Court Booking Agreement

WARNING:
1. Any individual who uses technological advantage or multiple/fake account to monitor calendar and/or book courts will receive a 6-month ban from booking. Upon a next infraction, the individual will face a lifetime ban from our facility and services.
2. Any individual who commits the following infractions will lose their booking and receive a warning for their 1st infraction, a 6-month ban from court booking upon the 2nd violation, and a lifetime ban for a subsequent breach:
- Any individual who is “sliding a booking” which is booking a court at an earlier time, then canceling halfway through to book for a later time;
- If the main player who booked a court is NOT present for their booking;
- Any individual who has more than one booking on the same day.

Please be courteous towards our staff and other players, and observe the following rules and court etiquettes:

1. 1. To book a court, you must have an account and be minimum 18 years of age. Please note minors are not permitted to have a separate account and book courts.
  2. To enter the courts, the main player who booked a court must be present, all players in your group must have an account and their names added to your booking.
  3. Players must claim their court within 15 minutes of the start time otherwise, we reserve the right to rebook the court.
  4. Players must be off the court promptly at the end of their booking (no last point, no huddles, no lingering or changing clothes on the court.) The clock inside the bubble is your reference to time.
  5. Please ensure all players on your court leave together to minimize disruption of play on the other courts.
  6. Please allow the rally/point to end before crossing a court.
  7. We reserve the right to change your court if needed.
  8. A player is allowed to have 1 booking of a maximum of 2 consecutive hours per day.
  9. To reduce crossing paths, players must enter and exit the courts in a clockwise direction.
  10. You shall claim your court sharp at the start of your booking and must be off the court promptly at the end of your booking (no last point, no huddles, no lingering or changing clothes on the court). The clock inside the bubble shall be the reference to time.
  11. Only four (4) players are permitted per court at any time.
  12. Players must wear appropriate tennis attire and non-marking tennis shoes. No clay-court shoes.
  13. No more than six (6) balls are allowed on the court, except for our programs.
  14. No chewing gum, food, glass or drink (except water) on the courts.
  15. No coaching on the courts.
  16. Court divider nets may be closed for the comfort of those needing a contained court.
  17. We reserve the right to revoke your court booking privileges if you violate the integrity and fairness of the booking system and refuse to serve you in future should you fail to follow our facility’s rule.
  18. We will not under any circumstance tolerate abusive and uncivil communication, and coercive and belligerent behaviour towards our staff and fellow players, and reserve the right to refuse serving you at our facility should you behave as such.

Online Account

1. - Each player/parent is permitted to have one account. Duplicate accounts will be deleted by the centre.

Privacy Policy

1. - Your privacy is important to us. The personal information you enter on the Merchant Link Pages such as credit card, name, phone number, email and mailing address, are protected by Moneris Merchant Services.

Personal Information

1. - This online site may request personally identifiable data from you, which may include your email address and other personal information such as your address & telephone number, etc., and in the case of online transactions, credit card number and expiration date. The Centre endeavors to do its best to protect the privacy of your personal information and will not use this information except in connection with your use of this online site and for the development of the website so that we can provide you with the highest quality of services. We may use your email address to send you information concerning the Centre's activities, unless you advise us that you do not wish to receive this information.

Currency

- All funds shown by Centre shall be in Canadian currency.

Tennis For Life, Let’s Play! Inc. & The Tennis Centre (Coquitlam) ACKNOWLEDGEMENT, RELEASE, INDEMNITY and ASSUMPTION of RISK regarding COVID-19 (FOR ADULTS & FOR THOSE UNDER THE AGE OF MAJORITY i.e. under 18)

This ACKNOWLEDGEMENT, RELEASE, INDEMNITY and ASSUMPTION of RISK regarding COVID19 is to be signed regarding each Participant in the sport of tennis and/or the games, practices, events, programs and/or activities ("Activities") organized, operated, conducted or sanctioned by the Tennis For Life, Let’s Play! Inc. ("Tennis For Life")., and The Tennis Centre ("TTC") at The Tennis Centre located in 1650 Foster Ave, Coquitlam, BC.
The undersigned, being the Public Players and their Guests, Program Participant and, if the Participant is under the age of 18, the Parent/Guardian of the Participant (each a “Party” and collectively the “Parties”), acknowledge(s) and agree(s) that:

(a) the World Health Organization has classified the Coronavirus Disease (“COVID-19”) outbreak as a global pandemic and are aware of the risks of COVID-19; (b) they are aware of the risks to personal health, including by the failure to follow physical distancing, flowing from COVID-19; (c) they are acknowledging and assuming all health risks and adverse health related consequences, dangers, and hazards to the Parties caused by engaging in any activities or arising from accessing, visiting, and using the properties, facilities, installations, and equipment (the “Assumed Risks”) owned, leased, operated, controlled, or used by Tennis For Life and TTC; (d) they are aware of the rules and policies set by Tennis For Life and TTC regarding safe return to sport (the “Policies”), that they will abide by the Policies, and that the Policies are subject to all federal, provincial, municipal and public health laws, regulations, by-laws and orders as they may exist from time to time; (e) each of the Parties hereby releases Tennis For Life and TTC, its members, officers, directors, employees, independent contractors, agents, and volunteers ("Releasees") from all liability, recourse, proceedings, claims, and causes of action of any kind whatsoever, in respect of all damages, personal injuries, death, or property losses which either or both of the Parties may suffer arising out of or connected with the Assumed Risks, the content or implementation of the Policies (including without limitation the conduct of any screening of any individual), and the preparation for, or participation in, the Activities, notwithstanding that any such losses were caused solely or partly by the negligence of any of the Releasees; (f) if the Participant is under the age of 18, the Parent/Guardian of the Participant hereby indemnifies and holds harmless the Releasees from any and all damages or losses of any kind as a result of any and all claims, demands, causes of action of any kind whatsoever including those involving negligence on the part of any of the Releasees that may be made or initiated by arising out of or connected with the Assumed Risks as they relate to either or both of the Parties, the content or implementation of the Policies as they relates to either or both of the Parties, and preparation for and/or participation in any of the Activities; (g) each Party understands that none of the Releasees assumes any responsibility whatsoever for the safety of either or both of the Parties during the course of any preparation for or participation in the Activities; (h) each Party will comply with the Policies and their implementation and that any failure on the part of either or both of the Parties to comply with the Policies may have consequences (including without limitation a withdrawal of permission to participate in an Activity or Activities) and could jeopardize relevant insurance coverage; (i) each Party understands that the implementation of the Policies may involve the collection, use and disclosure of personal information about of either or both of the Parties and each of the Parties consents to same; (j) each Party has carefully read this ACKNOWLEDGEMENT, RELEASE, INDEMNITY and ASSUMPTION of RISK regarding COVID19, and that each Party fully understands, and is freely and voluntarily executing, same; (k) each Party has been given the opportunity, and that each Party is encouraged, to seek independent legal advice prior to signing this document; (l) each Party understands that Tennis For Life and TTC would not permit either or both of the Parties to participate in any Activities unless the Parties have signed this ACKNOWLEDGEMENT, RELEASE, INDEMNITY and ASSUMPTION of RISK regarding COVID19, which applies to all Activities whether occurring in the near or distant future, and that the terms of this document need not be brought to the attention of either of the Parties each time either or both of the Parties participate in an Activity in order for it to be effective; (m) the term “Activities” as used herein includes, without limiting the generality of that term, court bookings for casual or social play, Weekly Socials, Learn, Practice, or Play and Team Play programs and training sessions, clinics, and events that are in any way authorized, sanctioned, organized or operated by Tennis For Life and TTC on its own or together with another; and (n) this ACKNOWLEDGEMENT, RELEASE, INDEMNITY and ASSUMPTION of RISK regarding COVID19 agreement is binding on each of the Parties, and their respective heirs, executors, administrators, personal representatives and assigns. By signing below, you agree to be bound this ACKNOWLEDGEMENT, RELEASE, INDEMNITY and ASSUMPTION of RISK regarding COVID19.

I CONFIRM HAVING READ AND ACCEPT THE ABOVE COVID WAIVER.
